Spare-bag Disclaimer, Safety Rules and User Responsibility

1. Spare-bag's role

Spare-bag is a technology platform that enables independent users to discover, connect, and communicate with one another based on travel routes and potential available luggage capacity.

• Spare-bag is not a carrier, courier, shipping company, freight forwarder, logistics provider, customs broker, travel agent, insurer, payment service provider, escrow provider, buyer, seller, agent, employer, partner, or representative of any user.
• Spare-bag does not transport, deliver, ship, receive, store, package, inspect, verify, declare, insure, customs-clear, collect, or take possession, custody, or control of any belongings.
• Spare-bag is not a party to, and does not guarantee, any arrangement, communication, meeting, travel plan, decision, or outcome between users.

2. Independent user decisions

Every user acts independently and is solely responsible for their own decisions, conduct, communications, travel, belongings, and arrangements with other users. Spare-bag does not verify or guarantee:

• The identity, honesty, reputation, intentions, conduct, reliability, or suitability of any user
• The accuracy of a user profile, travel route, travel date, location, or available capacity
• That a user will travel as stated, respond to messages, meet another user, carry any belonging, or complete any arrangement
• The condition, ownership, origin, legality, safety, contents, value, authenticity, packaging, transportability, or suitability of any belonging
• The successful completion, timing, safety, legality, or outcome of any user-to-user arrangement

Users must exercise independent judgment and take all appropriate safety, legal, and practical precautions before communicating, meeting, travelling, or making any arrangement with another user.

3. Border, customs, airline and security risks

Carrying belongings for another person, particularly across international borders, may create significant legal, financial, safety, customs, airline-security, tax, immigration, civil, and criminal risks. A traveller must never carry anything unless the traveller:

• Personally knows what it is
• Has personally inspected it
• Is legally permitted to carry it
• Understands and accepts full responsibility for carrying it
• Can comply with all airline, airport-security, customs, immigration, import/export, sanctions, tax, declaration, and local-law requirements that apply to the journey

Users must never carry unknown, sealed, suspicious, illegal, unsafe, restricted, prohibited, improperly declared, falsely described, or uninspected belongings. If a traveller is uncertain about any belonging, its contents, its ownership, its legal status, or whether it may lawfully be carried, the traveller must decline to carry it. Users are solely responsible for obtaining independent professional advice where necessary and for complying with all laws, airline rules, security requirements, border-control requirements, and customs obligations in the country of departure, every transit country, and the country of arrival.

4. Prohibited conduct

Users must not use Spare-bag to facilitate, advertise, request, offer, arrange, encourage, conceal, or support:

• Illegal activity or criminal conduct
• Illegal substances, controlled drugs, weapons, explosives, or weapon components
• Fraud, scams, deception, theft, money laundering, sanctions evasion, or tax evasion
• Transport of unknown, concealed, falsely described, unsafe, restricted, prohibited, or improperly declared belongings
• Activity that violates airline rules, airport-security rules, customs rules, immigration rules, import/export rules, or applicable laws
• Harassment, threats, discrimination, exploitation, abuse, or unsafe conduct
• False profiles, impersonation, misleading travel details, or deceptive information
• Any activity that may expose another user, Spare-bag, or a third party to legal, safety, financial, or reputational harm

Spare-bag may investigate reports, restrict visibility, remove content, suspend or terminate accounts, preserve relevant records, and cooperate with competent authorities where required or appropriate under applicable law.

5. No payment, delivery or transaction service

• Spare-bag does not operate a payment, escrow, wallet, payout, pricing, bidding, delivery, shipping, freight, commercial-transport, insurance, or dispute-resolution service.
• Spare-bag does not set, collect, hold, transfer, process, refund, guarantee, calculate, negotiate, or enforce any financial arrangement between users.
• Spare-bag does not guarantee or represent that any user-to-user connection, conversation, travel plan, meeting, or arrangement will occur or be completed.

6. Assumption of risk

By using Spare-bag, each user acknowledges and accepts that interactions with other users, travel arrangements, meetings, communications, and decisions to carry or request help with belongings involve risk.

To the maximum extent permitted by applicable law, each user assumes responsibility for risks arising from their use of Spare-bag and from interactions or arrangements with other users, including the risk of loss, theft, damage, delay, cancellation, customs seizure, airline refusal, legal action, financial loss, injury, dispute, fraud, or other harm.

7. Limitation of liability

To the maximum extent permitted by applicable law, Spare-bag, its owners, directors, employees, contractors, affiliates, licensors, and service providers shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, punitive, or other loss, damage, cost, expense, claim, liability, injury, or harm arising from or related to:

• Use of, inability to use, or reliance on the Spare-bag platform
• Any user profile, listing, route, message, connection request, communication, meeting, travel plan, or arrangement
• Any act, omission, conduct, identity, statement, information, or decision of a user or third party
• Any belonging carried, requested, received, lost, stolen, damaged, delayed, confiscated, refused, unsafe, illegal, restricted, prohibited, misdeclared, or otherwise affected
• Any customs, immigration, airport-security, airline, tax, import/export, sanctions, legal, regulatory, or enforcement issue
• Any fraud, scam, deception, impersonation, harassment, injury, dispute, or criminal conduct
• Any interruption, technical failure, data loss, unauthorised access, or unavailability of the platform

Nothing in this disclaimer excludes or limits liability that cannot legally be excluded or limited under applicable law, including liability for intentional misconduct, fraud, or other non-excludable liability.

8. User indemnity

To the maximum extent permitted by applicable law, users agree to defend, indemnify, and hold harmless Spare-bag, its owners, directors, employees, contractors, affiliates, licensors, and service providers from and against claims, losses, damages, liabilities, penalties, fines, costs, and expenses, including reasonable legal fees, arising from or related to:

• The user's use of Spare-bag
• The user's breach of these rules, the Terms of Service, or applicable law
• The user's belongings, communications, conduct, travel, declarations, or arrangements with another user
• The user's violation of customs, airline, security, import/export, sanctions, tax, privacy, or other legal obligations
• Any claim brought by another user, authority, airline, customs body, or third party arising from the user's conduct

9. Reporting safety or legal concerns

Users must immediately report suspected illegal activity, unsafe conduct, suspicious belongings, fraud, threats, harassment, weapons, illegal substances, false profiles, or other safety concerns through the platform's “Report a safety or legal concern” feature.

Spare-bag may review reports and take action in accordance with its Terms of Service, internal moderation procedures, and applicable law. Spare-bag does not guarantee that it will monitor all content, messages, listings, routes, or interactions. If there is an immediate danger, users must contact local emergency services, airport security, border-control authorities, customs authorities, or another competent authority directly.

10. Acceptance

By creating an account, accessing, browsing, posting, sending a connection request, communicating with another user, or otherwise using Spare-bag, you confirm that:

• You have read and understood this Disclaimer, Safety Rules and User Responsibility notice
• You accept these terms and agree to comply with them
• You understand that Spare-bag is only a peer-to-peer connection platform
• You accept personal responsibility for your conduct, decisions, communications, travel, and belongings
• You understand the legal and safety risks of carrying belongings for another person across borders
• You will not carry anything that you do not personally know, inspect, and have the legal right to carry
• You understand that Spare-bag does not guarantee any interaction, arrangement, travel plan, or outcome between users

11. Moderation, decisions and appeals

Spare-bag operates a moderation process for content and conduct that breaches these rules or the Terms of Service. Users can report any profile, route, capacity post, connection request, or chat with the “Report a safety or legal concern” button. The moderation team reviews the report, the reported content and, where relevant, the account history.

• Possible outcomes: no action, a warning, removal or hiding of content, restriction of a listing, limits on posting or messaging, account suspension, or termination.
• Affected users receive a decision notice stating what action was taken, its scope and duration, the report or facts behind it where appropriate, whether automated tools were used, and the rule that was applied.
• Affected users can appeal by replying to the decision notice or writing to contact@spare-bag.com; appeals are reviewed by a person who did not take the original decision.
• Where applicable, users keep the right to out-of-court dispute settlement and to judicial redress; nothing here removes those rights.
